Course Description

This advanced planning law course addresses some current substantive topics in land use law as well as exploring some themes that tend to emerge repeatedly in land use litigation. Substantive topics will be chosen by the instructors in the period immediately preceding each offering of the course to ensure relevance and topicality; these may include changes in provincial enabling legislation for planning and land use management, and judicial decisions from the British Columbia courts or the Supreme Court of Canada. Themes to be discussed include judicial deference to local elected officials (the test of reasonableness) and procedural fairness.
