Course Description

A society's laws draw both moral and legal boundaries in the name of civility and justice. Without the “rule of law,” we risk reverting to the “law of the jungle.” But what if the law clashes with one’s conscience or sense of fair play? For Martin Luther King, “One has a moral responsibility to disobey unjust laws.” How far might courts go in recognizing such claims—and what if they do not? We look at five landmark judicial decisions where the rule of law was challenged by those claiming to justifiably act outside of it—outlaws. Each case is part of our shared modern history in which we seek to square the demands of law and justice—and clarify what we mean when we speak about “dignity,” “freedom,” and “equality.”
